Compensatory Rest – Paid or Unpaid?
Guidance for stewards in England involved in discussions over new local on-call pay arrangements supporting the argument for paid compensatory rest.
This guidance was produced in response to a number of enquiries from stewards in England involved in discussions over new local on-call pay arrangements. It appears that many trusts are automatically adopting the approach that compensatory rest is unpaid. The CSP have always advocated paid compensatory rest and recent legal advice provided to the NHS Staff Council working group on on-call pay has indicated that there is case law to support this approach.
